General Terms and Conditions (AGB / GTC)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all services provided by Wingsuit Academy ("Provider"), Bahnhofstrasse 7, 6300 Zug, Switzerland, in connection with the Summit Wings program ("Program"). By registering for or participating in the Program, the participant ("Client") agrees to these GTC.

2. Services

The Program consists of a multi-phase training from initial skydiving instruction through wingsuit licensing to an advanced wingsuit flight. The exact scope is defined individually per Client and documented in a separate Program Agreement.

Services include:

  • Skydiving training and license preparation
  • Wingsuit training and license preparation
  • All coaching sessions (on-site, in-air, and remote)
  • Jump tickets for Client and coach
  • Equipment provision (state-of-the-art, regularly maintained)
  • Access to training facilities
  • Licensing and certification costs
  • 3rd party liability insurance during training
  • The apex wingsuit flight (weather and conditions permitting)

The following are explicitly excluded unless covered by a Concierge or Legacy package:

  • Travel and accommodation for Client
  • Travel and accommodation for coach(es)
  • Personal expenses
  • Personal accident or health insurance

3. Program Structure and Duration

The Program follows a phased approach with defined checkpoints and skill gates. The estimated duration from zero experience is 180 days. This is a realistic estimate assuming regular availability. The Program can be extended up to approximately one year. Extension beyond three years is not recommended as skills require consistent practice.

The Provider reserves the right to adjust scheduling based on weather conditions, training location availability, and safety considerations.

4. Two-Phase Decision Structure

The Program features a two-phase decision structure:

  • Initial Phase (Phase 1): Skydiving training and licensing. At the conclusion of this phase, the Client may decide whether to continue into Phase 2.
  • Main Phase (Phase 2 onward): Wingsuit training through to the apex flight.

If the Client chooses not to continue after Phase 1, a partial refund may apply as defined in the Program Agreement.

5. Pricing and Payment

The program fee is as published on the website or as individually agreed in the Program Agreement. All prices are in EUR unless stated otherwise. VAT is included where applicable under Swiss law.

Payment terms:

  • A deposit is due upon signing the Program Agreement
  • Milestone payments are structured according to program phases
  • Final payment is due prior to the apex flight phase

Specific payment amounts and schedules are defined in the individual Program Agreement.

6. Cancellation and Refund

Cancellation by Client:

  • Before program start: Full refund minus a reasonable administrative fee
  • After Phase 1 completion: Partial refund as specified in the Program Agreement
  • During Phase 2 for medical reasons (documented by a licensed physician): Partial refund, prorated based on completed training milestones, as defined in the Program Agreement
  • During Phase 2 for non-medical reasons: No refund for completed milestones; unused prepaid phases refundable minus administrative costs

Cancellation by Provider:

  • The Provider may terminate the Program if safety cannot be guaranteed, if the Client fails to meet medical or fitness requirements repeatedly, or if the Client's behavior endangers themselves or others
  • In case of Provider-initiated termination, a prorated refund applies for uncompleted phases

7. Safety and Liability

The Client acknowledges that skydiving and wingsuit flying are inherently risky activities. The Provider implements comprehensive safety protocols, including:

  • Medical screening prior to program entry
  • Conservative decision-making policies for all flight activities
  • Strict operational constraints (weather, wind, visibility)
  • Full incident response planning
  • Progressive skill gates with no advancement without demonstrated competence

The Provider's liability is limited to cases of intentional misconduct or gross negligence. All participants sign a detailed risk acknowledgment and informed consent form. The Provider maintains 3rd party liability insurance for all training activities.

The Client is strongly advised to obtain personal accident and health insurance suitable for extreme sports activities.

8. Medical Requirements

  • All participants must be in general good health
  • Participants aged 60 or older must provide a medical certificate from a licensed physician
  • Maximum body weight: 90 kg (for safety compliance with equipment limitations)
  • The Provider may require additional medical clearance at any point during the Program

9. Confidentiality

Both parties agree to keep all aspects of the Program confidential, including the Client's participation, personal information, and program details, unless explicitly agreed otherwise in writing. No photographs, videos, or identifying information about the Client will be published without written consent.

10. Intellectual Property

All training materials, methods, and program designs are the intellectual property of Wingsuit Academy. The Client may not reproduce, distribute, or use these materials for commercial purposes.

11. Force Majeure

Neither party is liable for delays or non-performance caused by circumstances beyond their reasonable control, including but not limited to severe weather, natural disasters, pandemics, government restrictions, or airspace closures. In such cases, the Program schedule will be adjusted accordingly.

12. Governing Law and Jurisdiction

These GTC are governed by the laws of Switzerland. The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC and the Program is Zug, Switzerland.

13. Amendments

The Provider reserves the right to amend these GTC. The Client will be notified of material changes. Continued participation constitutes acceptance of amended terms.

14. Severability

If any provision of these GTC is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intended purpose.
